New York Aunt Attempts To Sue Her 12-Year-Old Nephew For Hugging

A woman from New York is the curator of a court case that is as troubling as it is puzzling.

Jennifer Connell of New York is currently trying her hand at a court case involving her 12-year-old nephew, Sean Tarala. Connell is attempting to hold the pre teen liable for events which ultimately left her with a broken wrist.

The incident occurred at Tarala’s birthday party a few years ago.

Her nephew, only 8 years old and 50 pounds at the time, shouted, ‘Auntie Jen, I love you!’ and jumped into her arms.

“All of a sudden he was there in the air, I had to catch him and we tumbled onto the ground,” Connell stated.

This seemingly genuine exchange resulted in a broken wrist.

Connell says she didn’t let her nephew know at the time that she was injured.

She claims she didn’t want to ruin his birthday but says life has become increasingly difficult since the incident.

“I live in Manhattan in a third-floor walkup so it has been very difficult,” Connell said Friday at Connecticut Superior Court in Bridgeport. “We all know how crowded it is in Manhattan.”

Apparently the associated struggles have been deemed detrimental to Connell, as she is suing for the amount of $127,000. She has hired an attorney for the case. Which makes one wonder what type of lawyer would pick up a case like this? Even with proper communication and a well constructed plan, the likelihood of this case going through seems very slim.

Connell’s lawsuit claims that “a reasonable eight year old under those circumstances would know or should have known that a forceful greeting such as the one delivered by the defendant to the plaintiff could cause the harms and losses suffered by the plaintiff.” This left the jury with the curious task of addressing what exactly a “reasonable” 8-year-old would know.

Jennifer Connell works as a human resource manager. One would think that a person on that career path would be more understanding. Beyond that, there is the simple fact that it’s her nephew!

To add insult to ‘injury’, Tarala’s mother had passed away the year prior to the incident. He’s seen a rough patch in life, and a case like this is certainly hurting not helping.

Connell claims that Tarala is always “very loving and sensitive toward her” but continued to push the case as it went to court today.

A breath of fresh air was released when the case dismissed in only 25 minutes. Connell left the courtroom and fled without saying a word.

“We just couldn’t find him, you know, liable for what happened,” a female juror said regarding young Tarala.

It was ruled that Connell was not entitled to any compensation from her nephew or their family.

Sure there are some weird laws still in place in America, but at least issues like these are dealt with in a realistic and civilized manner. The only thing Tarala is guilty of is trying to hug his aunt at his birthday party. Connell, on the other hand, will undoubtedly see far more unwanted attention in the future. Just like Gerod Roth, the world has her labeled for these poor choices. The public eyes is always watching, even if you’re a marketing whizz, or a veteran human resource manager.
